So when Foster is released, he’ll head to the waiver wire, where any other team can claim the balance of his rookie contract.

As pick No. 31, Foster initially had a fully guaranteed salary for 2019, in the amount of $1.286 million. A prior suspension likely erased the guarantees, however, which means that neither a new team (if the contract is claimed) or the 49ers (if it isn’t claim) would owe Foster the money. His base salary for 2018 is $875,000; his pay for the final five games of the season would be $257,000.

Although it’s unlikely that a suspension without pay would be finalized before the end of the season, any team that would claim or otherwise sign Foster would risk being required to pay him during a stay on the Commissioner Exempt list, a device for keeping players off the field when those players face certain types of criminal charges, including allegations of domestic violence.

It's not like his only two arrests were these DV charges. He also has a drug arrest and a weapons charge (pled no contest to the latter, had a diversion program for the former) and served a two game suspension this year.

He's a bad cookie, and will be facing another suspension, at the very least. Almost certainly jail time, too.

Not going to question why people keep dating their accuser. People in love can do crazy things.

But that accuser lied before. If it were someone else, okay. But this accuser lied last time. Reading what happened, won’t be surprised if she lied again.

I think 49ers are upset that he still was seeing her after likely agreeing to end it. Anyways, he’s talented and good against the run. And it would be nice to have an ex-49ers 1st round pick flourish with us for them to see.

She didn't lie last time, she realised if she told the truth her meal ticket would go to jail and never make another dime. He's a POS, always has been.

Let's just be clear. Recanting almost never means lying.

It means that someone who's unfortunately in love with an abusive person doesn't follow through because they are still thinking they can make it work AND that it would be harder if that person lost their job.

How many times has an abuser said to the abused, "please, baby, I love you. If you press these charges, I'll lose my job and I need that to take care of you..."

Really REALLY don't want to get into this...again...about this, but yeah...recanting almost never means lying.

So you want the Rams to claim a LB that failed his drug test pre-combine, got into an altercation with medical staff over said failed drug test, failed another drug test, had one DV charge dropped, and now has another one pending that appears to have several witnesses. Never mind this is a LB that has 29 total tackles this season and ZERO sacks for his career.

I suppose it doesn’t matter as he’d have to fall through 30 other teams before we’d even have a shot at him.

Even if we had a shot at him.... HARD PASS.

Nick Fairley arrested in Mobile, charged with menacing

Former NFL defensive tackle Nick Fairley was booked into Mobile County Metro Jail on Friday afternoon after being charged with two counts of menacing, threatening someone with a gun.

According to the Mobile County Sheriff’s Office’s jail log, the former Auburn standout entered jail at 4:48 p.m. CST Friday.

Fairley has been out of football since Feb. 5, 2018, when he was released by the New Orleans Saints. He spent the 2017 season on reserve/non-football illness after a specialist recommended he retire because of a heart condition.

A physical at the NFL Scouting Combine in 2011 found Fairley had an enlarged heart, but that didn't prevent him from playing six NFL seasons.

Fairley entered the NFL as the 13th player picked in the 2011 NFL Draft after winning the 2010 Lombardi Award for Auburn's BCS national-championship team.

In four seasons with the Detroit Lions, Fairley played in 46 games, with 30 starts, and recorded 98 tackles, including 13.5 sacks. The Lions let Fairley leave in free agency after his rookie contract was up, and he spent 2015 as a St. Louis Rams' reserve.

Fairley had a rejuvenating season after signing a one-year contract with the Saints in 2016. A year after not starting a game in his only season with the Rams, Fairley started all 16 games for the first time in his NFL career. He recorded 45 tackles and a career-high 6.5 sacks, and the Saints signed him to a four-year, $28 million contract on March 9, 2017.

Fairley was an All-State football and basketball player at Williamson in Mobile.

The 49ers released troubled linebackerReuben Foster on Nov. 25, hours after he was arrested at a Tampa hotel and hours before the team was set to face the Buccaneers. Foster was booked on one count of first-degree misdemeanor domestic-violence battery.


Foster's alleged victim was Elissa Ennis, whom the linebacker has at times been in a relationship with over the past three years. In a statement, Tampa police said Foster and Ennis were involved in a verbal altercation Saturday and "Foster slapped her phone out of her hand, pushed her in the chest area, and slapped her with an open hand on the left side of her face. Officers observed a one-inch scratch on the victim's left collarbone."

Ennis spoke with Good Morning America in an interview that aired Thursday morning and said she felt police officers didn't believe her when she placed a 911 call from the Tampa hotel in part because 49ers officials told officers that Ennis had previously recanted allegations of abuse by Foster.

"Even when I called the police, the 49ers came up there," Ennis said, via ABC.com. "... I have pictures of the 49ers coming up there trying to talk to the police telling them I'm the same ex-girlfriend that set up there and lied."

Ennis had traveled to Tampa to work on her relationship with Foster. The two currently weren't together.


"We both were seeing therapists and stuff, trying to work on our relationship," she said. "So I was like, 'I can't believe you -- you're back to doing this,'" Ennis said of the alleged hotel confrontation.

In May, three months after Foster was involved in an incident that led to three felony charges, Ennis recanted allegations that Foster had dragged her by her hair, physically threw her out of the house, and punched her in the head eight to 10 times in a February incident that led to the linebacker's arrest.

"I wanted him to go down. I was pissed," Ennis, said at the time.

But Ennis told GMA she lied when she said Foster was never physical.

"I was not telling the truth. I was not telling the truth," Ennis said. ... "I did what I had to do for the person I loved. I thought he would change. Anybody in my position would do the same," Ennis said.

Ennis said her original account to authorities was what actually happened before Foster's February arrest.


"Reuben threw my clothes off the balcony, he threw my stuff out the house, he dragged me down the stairs two, three times, he punched me in my face two, three times, he pulled me by my hair, kicked me, spit on me," she said.

Two days after the 49ers released Foster, the linebacker had a new home with the Redskins, who claimed him on waivers. CBS Sports NFL Insider Jason La Canfora reports that other teams around the league were shocked and dismayed by the move. Ennis was also in disbelief.

"When he got signed, I was like, I can't believe somebody picked him up," she told GMA. "... I just couldn't believe somebody picked him up in less than how many hours? I was shocked."

The NFL placed Foster on its Commissioner Exempt List, which means he can't practice or attend games, but can be at the team's facility for meetings, workouts and and other permitted non-football activities. But, as La Canfora notes, Foster has previously violated the personal conduct policy and as a result, could face severe discipline.

I heard on a local sports talk show that he was going to be making efforts to repair his image. But the other assault case investigation hasn't been closed that I know of anyway.

It may be too much to overcome.

Who did he try to kill?

An ex-girlfriend. And he did it in front of her two kids.

If this is true, and it sounds like she is credible, the NFL should look into this and find out who on the 49ers staff did that and they should be terminated.

No Roger you don't pay for video evidence, but you have no problem burning it.

Not the best position for the NFL to take. Investigators spend money to get their investigations done - that’s how it works. That is, if they really want answers.

If this kid were a first round draft talent, you bet your ass scouts would pay to get the information. If you want to know, you can find it. If you don’t, you won’t. But in this day and age, if you don’t - someone else will - and you will be right do outed as not really having wanted to know in the first place.

Either investigate, or don’t. But don’t pretend.
