She went the next day. I’m sure it was a very traumatizing event. Plus drinking and being drugged. Takes a while to get your mind straight, face the fear and go to police.

The waiting issue with police makes sense considering the sting call they setup. You can’t do that once the cat is out of the bag with perp knowing the police/etc. is officially involved.

If she went to the cops promptly and they did tests, then Araiza told her to get checked for STDs then that’s enough right there imo. If not then, I don’t understand our justice system.

If the cops took samples then a simple dna test of the accused could be used as proof.

She did. They did. She worked with detectives to call Araiza, he admitted to sex and told her to get checked for std on that call. When she clarified, ‘so we did have sex?”, he saw what was happening and reversed course saying he didn’t remember and hung up.

this isn’t an admission by her of consent, btw, for anyone confused, as she was incapable of consent.

the police have her drug tox report and have stated she had alcohol and other intoxicants in her system.

while the civil suit is happening now, the criminal case seems to be being built to make it stick

he’s done.

What is the age in California for sex to be considered legally consensual or illegally with a minor?

Can anybody who has decent idea tell me why in the hell would a lawyer file a civil case even before a legal case is filed or convicted?

I was under the impression that those usually come after a criminal case? Is that a wrong assumption?


Anyways, if this is true I have zero empathy for him, hope he goes to prison and gets severely beaten a few times.
Just wow always give people the benefit of the doubt and wait for things to be decided legally but this doesn't look good.

I feel you, it’s hard to give someone the benefit of the doubt but it’s 100% should be given. About 12 years ago I was accused of domestic violence in two different courts and dismissed twice. You never know what a pos ex relationship can put you through.

In a former life I was in jail for a while, i had a cellmate for a long while and they suddenly came in and moved him for no reason which made us question why? The next day the moved in some skinny ass dude from Oklahoma which turned out to be a pedophile. Guy lasted only 3 hours in there.

I think your idea should be given merit in the system.

In this case the ages 21 and 17 that is considered statutory rape in California. For the Romeo and Juliet it has to be 3 or less year difference, it’s still a crime but not a felony.

There's a player on the Premiere league soccer team I root for right now working to clear his name. He converted religion for the lady he was in a relationship with. She proposed to him and he refused. The following Monday she field sexual assault charges on him. Nobody knows the details I think but those two but he's going through that very same thing clearing his name. Everybody accused and accuser deserves to have their side heard. Unfortunately that thing called the court of public opinion very rarely allows for that.

I think that says 3 or fewer years age difference which this seems to be 4 years?

They likely filed civil first for two reasons:

1) bar for conviction is lower and evidence admitted in civil convictions has higher chance to be admitted in criminal case. Also, monies lost at civil trial can’t obv be used in criminal defense.

2) filing civil early means greater chance for restitution. If he’s on trial (criminal) and blows all his money, he’s got little to worry about losing to a civil verdict. Sometimes, a DA will work with civil attys to mount a coordinated plan to effect best outcome.

That’s obv not everything, but it’s a start

Bills now admit that there is new information in the civil lawsuit that they were not aware of previously. Hence him not playing yesterday nor on sidelines. From yesterday:

McDermott said he learned some new information in the last 24 hours regarding Araiza and that he hadn't slept much, but declined to go into specifics about what the organization previously knew, how thorough the team's investigation was, and if he felt Araiza had lied to him and the team.

"I would say there's been some [new information in the last 24 hours], and I'm not going to deny that, and that's why I have more work to do on this," McDermott said. "I'm more trying to be solution-oriented right now. And that's where I'm headed. And that's where we need to be headed."
