It's not a misdemeanor if you have to register. 18 Months is a PRISON sentence... this is a FELONY.

The link Ram65 posted says differently. 18 months would be 6 months for each of the charges, so a total of 18 months - that's in the unlikely case that sentences had to be served consecutively. And yes, in California some misdemeanors have to register for at least 10 years.

I went through this same process, personally... (for peeing in a bush in California)... for a sex crime, a registerable sex crime is a Felony Sex Crime. Especially when it's inside a womans home, while she's asleep.

Not just a simple indecent exposure (flashing) crime.

Please read post #9 in this thread, where the actual relevant California legal code is cited, including the difference between misdemeanor sexual battery and felony sexual battery. Your charge was neither. Rath's is classified as misdemeanor sexual battery, which in California can require registration.
 
I have no legal background whatsoever and I understand beyond a reasonable doubt....But, what does the woman have to gain by pressing these charges? Again he could be acquitted because the prosecution did not prove their case, however, that does not mean he did not touch her. Again, have to let this play out, but to take it to this level, what did the allege victim have to gain?

Attention, money, revenge on him for something, revenge on his wife for something, mental illness, victim complex, a lie spun out of control and she is afraid to now tell the truth .... honestly, I’m not sure she knows what happened - she was asleep. She may not be pressing these charges at all.

Interesting look at this. Bold print could be reasons she made the accusations most I didn't think about.

I would think she had to press charges at least for the investigation. I'm no law expert.

It says she went to sleep but, we don't know if she was sleeping at the time of the alleged incident.

Not sure about California law - but in many states, it’s not up to the victim whether or not to press - at least not entirely. As a practical matter, generally the state needs the victim to cooperate in order to win, but they can often press forward even with an unwilling victim.

So when you make her hold it for you, then what is that charge ?? Not sure I’m following right ? The judge will make the questions real clear on the counts being charged & what the differences are though.

Reread this again. Wow - it is interesting to me why they waited from June 15 until January 15 . Right before the high light of his career ?

His wife got her hair done by prosecutors client that said he touched her inappropriately.

The prosecutor said the other guys at the party were drinking as well, but Ted was intoxicated.Hard to tell if they were all neighbors though ?

Will the wife be involved or questioned ? This has a lot of twist , compared to Luke Walton’s case.

Ted Rath has been a very big influence on The Rams & Mcvays early era. He was always full of energy, keeping players pumped. Now I wonder what his role will be, or if his career has taken a huge hit ?? Watching him in camp & being able to be such a big part of The Rams 2018 season with this whole case was never brought to anyone’s attention. Blows my mind why this was , not reported earlier. Wonder if any of this is brought up ?? Why keep a sex offender loose ,if such an offense ? Why not wait until after the season? I always find reasonings interesting.Peoples mind sets.

So in a state where people take a dump on the sidewalk you were cited for applying nitrogen to a bush?
 
The updates are not promising for Rath. Defense attorneys previewed an “incapable of forming the specific intent” defense and said Ted will testify. It looks like there won’t be a dispute as to whether he did it - but the “why” will be in play. He may win the trial, but under these facts, not sure he comes back to the team.

I dunno, I read it the opposite way— sounds like the defense might be able to establish that Rath was bombed out of his mind, in part because of medications for a recent health problem. If so, it would indeed be hard to establish that Rath was capable of the “specific intent” required to convict.

I haven’t followed the case closely, nor do I have a stake in the outcome one way or another. I am simply saying that it sounds like Rath is getting a good defense from his lawyers.
