(CNN)Erica Kinsman, a former Florida State University student who has accused star football player Jameis Winston of rape, has filed a lawsuit against the Heisman Trophy-winning quarterback, her lawyer said Thursday.

Kinsman has said Winston raped her in December 2012. A prosecutor decided against bringing criminal charges in the case.

In the lawsuit filed Thursday, Kinsman alleges sexual battery, false imprisonment and intentional infliction of emotional distress.

CNN has attempted to contact Winston's attorney for comment but has not received a reply yet.

Winston has said the sex was consensual.

CNN doesn't normally identify the alleged victims of sexual assault; however, Kinsman revealed her name this year in a documentary about rapes on college campuses.

FSU hearing clears Winston

Winston led the Florida State Seminoles to a national championship for the 2013 season. That year he won the Heisman Trophy, given to the most outstanding collegiate football player. He is expected to be a top pick in the NFL draft that begins April 30.

"As for timing, we didn't want to wait until the eve of the (NFL) draft or after he signed (an NFL) contract," attorney John Clune said. "As soon as we finished the various motions briefing on the FSU case, we turned our attention to Jameis and got it filed."

Kinsman also sued the university in January.

According to police documents in the rape case, Kinsman said Winston raped her after she had been drinking with friends at a bar in Tallahassee. She said an unknown man gave her a shot glass of liquid before they left the bar.

Kinsman also said she did not remember much of what happened next but that she remembered being in a ground-floor apartment, where Winston took off her clothes and had sex with her despite her objections, according to police documents.

Kinsman reported the alleged assault to campus police that night. A month later, in January 2013, she accused Winston of the alleged rape.

Tallahassee's interim police chief at the time, Tom Coe, said the woman "broke off contact" with investigators in February 2013 and didn't want to go forward with the case. The woman's family said a detective warned her attorney that Tallahassee is a "big football town" and that life could be miserable if she pursued the case.

Winston didn't play during the 2012 season but came to Florida State as one of the nation's top quarterback recruits, according to recruiting rankings.

No surprise. Nothing for her to lose. And since she'll have a jury, she actually stands a chance of winning (whereas if it were just a Judge, I think she'd lose based on the evidence I've seen). Odd, though, that she's using IIED. Well, not really odd since you can throw out as many claims as possible but it's pretty much impossible for her to win on it.

I always thought, innocent or not, something further should have been done in the investigation so it wasn't just a he said/she said clusterfuck.

But the sad truth is, in too many cases, that's all the girl has to go on if rape did indeed occur.

When there is no proof though it usually favors the man. The description the roommate gave made it sound like it was leaning more towards rape.

A few years ago a highly recruited RB at PSU was accused of raping a girl. He was kicked off the team and he never returned to football. It came out about 4 years later that the girls roommate said she lied and that the girl thought he would be a big time NFL player and wanted to cash in. Up until then everyone believed her. It ruined that runningback.

These are tough cases. Difficult to know what happened. A sliver lining could be that regardless of the outcome, if she was indeed raped, he might be dismayed from doing it again. On the flip side, if he gets away with it, he might be empowered. And Cosby showed us that you can be in the spotlight and still be a serial rapist.

Your probably right it was inapropriate. I have no idea whether or not this actually happened or not. But It wouldn't be the first time a women has tried to screw a man out of his money.

Yeah, sadly it happens all the time. Seeing it happen to Steven Jackson probably influences Rams fans even more.

It's sickeningly poor taste though, bro. Women hardly ever win rape cases in the first place when it happens and that's usually only when the evidence is staggering. Never mind the men who routinely get away it (as already evidenced by a former NFL star who was a serial rapist) and the 1000s of rapes that go unreported.

Completely agree. I don't know if Winston raped her or not, and we'll probably never know. But that's very poor taste all the same. I mean, look what Sharper did and how lightly he got off.

It's a sad state of affairs when a women says she was raped, the accused is deemed innocent until proven guilty while the accuser is a liar until proven otherwise

Poor taste, but even I cracked a smile and some would probably label me a SJW.

I wonder if many of us can agree though that much of our ire should be placed at the feet of the Talahassee police for not doing their job better - strike better - at all. We may never have known what happened but because of their #$$#@ ups, we'll have even less a chance of knowing.
