No one's saying he SHOULD have been arrested. He's a fucking moron for being unable to AVOID being arrested. BIG difference!!!!!
Why would he have avoided being arrested?
He moved when the cop asked him to. Maybe it wasn't far enough for the cop, but he did move, and it's up to the cop to keep his cool and explain things, not Branch; we're talking about public servants vs. private citizens, so the onus is on the officer to not escalate - to deescalate, for that matter - unless he has a reason to fear for his life or the lives of other people.
Branch was also on a public sidewalk when he was asked to move. It's not illegal to be on a public sidewalk. It's not illegal to be out late at night. Unless there's a crime or emergency happening on that sidewalk or on the street next to it, Branch has every right not to move. Even if it was a crime or emergency, if Branch didn't move far enough, again, the onus is on the officer to deescalate, not arrest Branch for not moving far enough and "smirking". Even if he is being a punk in the process - which, as of yet, we don't know either way - that doesn't mean he should be arrested and charged with misdemeanors for supposed "disrespect".
I'm willing to wait for more info to come out for all sides, but right now, this seems like nothing that Branch should've been arrested over.
