49ers defensive end Ray McDonald, due in court on Monday in connection with domestic violence allegations, no longer is due in court on Monday.

Via ESPN.com, the Santa Clara County district attorney announced on Friday (via Twitter, of course) that the hearing has been canceled as the investigation continues.

The court date will not be rescheduled “unless or until charges are filed.”

The 49ers have continued to allow McDonald to play, citing the same notions of “due process” that ultimately were not honored in connection with Vikings running backAdrian Peterson (who faces child abuse charges) and Panthers defensive end Greg Hardy (who was found guilty of domestic violence via a preliminary trial in July, who played in Week One, and who was then yanked from the field as of Week Two). Through it all, the NFL has not provided to the public an explanation of the distinctions between the cases, which results in a potential perception of inconsistency — and definitely a lack of transparency.

Multiple reports have indicated that the 49ers believe McDonald is innocent. That’s fine, but in situations like this the ultimate decision shouldn’t be left to the team, because the team has an inherent bias to resolve the situation in a way that allows the player to keep on playing.

Unless the player resides near the bottom of the roster. If that were the case, the 49ers would have cut McDonald several weeks ago.

Uhhhh wow. So Florio is suggesting that he should be suspended until the Police decide to file charges? How the hell was the guy a lawyer?

This is not a football issue to me - this is simply a due process and a rights issue.

There isn't a perception of inconsistency - people know every case is different - it's not like every guy has video hitting their wife in an elevator... and yea there's going to be a lack of transparency as long as the police have an open investigation... lol it's so easy to see how this guy failed as a lawyer and is a terrible sports writer.

Sorry for the rant, but his level of ignorance is astounding...

I'm sure he wouldn't be filing motions and lawsuits if he were suspended from his job for being arrested, but never charged.

Eh, plenty of other companies will suspend an employee if they're in legal trouble until charges get filed. With all the stuff going on now, the NFL would look pretty bad if he ends up being guilty. If/when the investigation ends and they don't want to charge him, then I'd bring him back and ensure he got all the pay he should have gotten. I think his point is more that it can go either way, but if he's guilty they piss off a lot more people for not suspending him, than if he's not guilty and was.

Suspending someone before charges are filed is premature at best - and I have my doubts about companies suspending employees without charges filed unless there's something written into their contract.I doubt it because if charges are never filed, they are now a gigantic target for lawsuits.. Lost pays, wrongful termination if they're fired, etc.

No problem with suspending someone IF charges are filed pending the outcome of the conviction

If a company wants to distance themselves from people for their own image they can. You just should make sure you do the right thing if charges are not filed.

eh that depends on what the arrest/accusation is for - I'm talking about something that happens outside of work, on your own personal time - such as a DUI, domestic violence, whatever you got yourself into... I completely disagree with suspending someone just for being accused - if you're arrested but charges aren't filed that pretty much means that can't prove it, yet. Until they can or atleast have something they can file a charge with, I don't think any action should be taken...

And I believe schools would fall under one of those areas that's covered under specific areas that has something written into theri contract - for example if there's an allegation against someone involving a child, of course they're gonna be suspended pending investigation...but that's a completely different set of circumstances than what I'm talking about.

Look at the Patriots and Hernandez - he wasn't cut til charges were filed.

AP was suspended before charges were filed, so the NFL leaves it up to the team. Most players low on the chart just get cut usually.

He still played against us week 1 - he just didn't need to play in the preseason.

Eh, I dunno I still don't think its a big deal. With a high profile employer like the NFL, and all the flack their catching now, I would understand if they decided to suspend the player. If it comes out they let a player play and he does come up as guilty, they're likely to face even more backlash, and they don't want to lose sponsors. At any rate, it seems the 49ers are going to let him play anyway, so its all moot anyway.

A school in my area suspended, then terminated the head football coach because a janitor thought he saw child pornography on the coach's cell phone. Turned out to be pictures of his own children and after investigations and visits from social services it was found to be a non-issue. The school then changed its tune and claimed he was fired for misuse of company property (his wife used his school issued laptop). If I recall correctly in lieu of lawsuit the coach actually accepted a deal to come back to his job.

Just a funny, somewhat related story.
